Defective Products

     Defective products have the ability to cause injury and death.  An airbag that does not deploy, an electric saw with a safety guard that does not work, etc .  

 

    There are several types of defective product cases.  One is called a manufacturing defect.  This means that there is some flaw in the product that occurred when it was being made.  The best way to understand this is that a manufacturing defect is akin to the one bad product in a batch. 

 

     A design defect is where a company makes the product and there is something wrong with the way it is made.   If there is a design defect, the entire batch is bad. 

 

     The third kind of defective product is the warning defect.  Some products are fine, so long as they are used properly.  However, sometimes there are very specific uses that are very dangerous.  A company that makes a product has a duty to warn of any known hazards. 

 

     Mr. Magee has handled dozens of defective products cases, and knows the law inside and out.  As a law clerk, he wrote a practice guide for an insurance defense firm, summarizing the entire body of product liability law in Arizona to that time.
